Update for VDA Member Dentists on Cosmetic Botox Regulations in Virginia

In 2023, with support from the VDA, the Virginia General Assembly passed and Governor Youngkin signed Senate Bill 1539, sponsored by Senator Todd Pillion, which required the Board of Dentistry to establish training and continuing education requirements for dentists related to the administration of botulinum toxin injections for cosmetic purposes and requires the Board of Dentistry to amend its regulations to remove botulinum toxin injections from the list of procedures requiring additional certification for oral and maxillofacial surgeons.

An emergency clause included in the 2023 state budget accelerated the process of developing those regulations. 

VDA members and VDA counsel participated in a work group to develop the emergency regulations, which were voted on and approved at the Board of Dentistry’s December 14 meeting. 

Draft Regulations Text

They have gone through review by the Office of the Attorney General and the Virginia Department of Planning and Budget and are currently being reviewed by the Secretary of Health and Human Resources. Once reviewed and approved by Secretary Littel and Governor Youngkin, the emergency regulations will be submitted and published in the Virginia Registrar and at that point they will be in effect. 

The VDA will remain engaged as they go through the final stages of the process and notify our members when they go into effect.

The VDA is working with our component societies to provide convenient access to continuing education that meets the requirements of the emergency regulations for members interested in cosmetic Botox. The VDA will share details with members when they become available.
