Ask Your Congressman to Support HSA eligibility for Over-the-Counter Oral Health Care Products

The American Dental Association (ADA) is supporting a new bipartisan bill that would allow health savings account (HSA) and flexible spending account (FSA) reimbursement eligibility for over-the-counter oral health care products, including toothbrushes, toothpaste, and dental floss. 

Today, we are asking you to tell your Representatives to support H.R. 8599, which would make over-the-counter oral healthcare products eligible for HSA reimbursement.   

The ADA recently sent a letter thanking Reps. Nicole Malliotakis, R-NY, Jeff Van Drew, R-NJ (ADA-member dentist), and Brad Schneider, D-Ill for introducing H.R. 8599. Oral healthcare products are not only essential for good oral health, but for health in general. A growing body of evidence also links systemic health to oral health, making it clear that oral health products are essential to Americans’ health. Americans should not be taxed on products like toothbrushes, toothpaste, and dental floss that are necessary for maintaining their health.    

This bill would treat amounts paid for menstrual care products or oral healthcare products as paid for medical care for purposes of eligibility for health savings account (HSA) and flexible spending account (FSA) reimbursement. An “oral healthcare product” would be defined as “an over-the-counter anticaries drug product or antiplaque/antigingivitis over-the-counter drug product suitable for topical administration to the teeth or gums that is generally recognized as safe and effective under Section 505G of the federal Food, Drug, and Cosmetic Act.” Oral healthcare products would also be eligible for reimbursement by Archer medical savings accounts (MSA).
