Law360, New York (February 25, 2015, 10:14 AM ET) -- The U.S. Supreme Court on Wednesday ruled that state professional boards controlled by active market participants must be supervised by state governments to avoid federal antitrust scrutiny, siding with the Federal Trade Commission in a dispute with North Carolina's dental board.

In a 6-3 ruling, the justices concluded that the state action doctrine does not protect the North Carolina State Board of Dental Examiners from the FTC's challenge to its policy blocking nondentists from offering teeth-whitening services.

Governor McAuliffe has recently initiated a 10 step plan to increase the health of more than 200,000 Virginians.  As part of that plan, pregnant women on Medicaid (21 years old and older), shall have the opportunity to receive much needed dental care through the dental Medicaid program.    Beginning March 1, 2015, Virginia's Smiles For Children program will provide dental benefits to pregnant women in Medicaid and FAMIS including:

A final rule was published by the Centers for Medicaid and Medicare Services (CMS) in 2014 that requires practitioners who prescribe Part D covered drugs to be enrolled in Medicare or opt out for those prescriptions to be covered under Part D.  This means that neither the practitioner, nor the beneficiary submits the bill to Medicare for services rendered. Instead, the beneficiary pays the physician out-of-pocket and neither party is reimbursed by Medicare.

Over 120 dentists and VCU dental students gathered very early for the annual VDA Day on the Hill on Friday, January 16.  Breakfast was held at the Omni in downtown Richmond where they heard from their fellow VDA member dentist Dr. Todd Pillion who is now a new member of the VA House of Delegates.  They also heard from VDA President Dr. Mike Link, VADPAC Chairman Dr. Bruce Hutchison and VDA Lobbyist Chuck Duvall.  After breakfast, the group headed up the hill to visit with their legislators at the General Assembly building.
